1. Service Description
BlueTool provides a call-handling and notification system that captures inbound service requests and delivers them to business users. Our AI-driven platform is engineered to assist home service businesses in capturing missed opportunities and optimizing operational responsiveness.
2. No Guarantee & Reliability
While BlueTool strives for maximum uptime and accuracy, we provide no guarantee regarding revenue, job outcomes, or the absolute capture of every call. The service is provided 'as is' and depends on third-party telecommunications, messaging, hosting, and AI providers.
3. User Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to use the service only for lawful personal or business purposes and in compliance with all relevant U.S. regulations.
4. Billing & Cancellation
Services are billed on a recurring basis as agreed upon during registration. Cancellation of service must be performed according to the specific agreed-upon billing terms. BlueTool reserves the right to adjust pricing with prior notice to the user.
5. Limitation of Liability
To the maximum extent permitted by law, BlueTool shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. For any inquiries regarding these terms, please contact dan@getbluetool.com.

BlueTool is a communication and notification system designed to capture inbound inquiries. Please note that our system does not diagnose technical issues, provide pricing estimates, or replace your existing skilled technicians. We do not guarantee specific business outcomes, revenue increases, or job completion results, as these depend on your team's operational response and service delivery.
Billing and Cancellation
Recurring Billing Structure
BlueTool services are provided on a subscription basis. By enrolling in our service, you agree to recurring billing as specified in your service agreement. Fees are automatically charged to your chosen payment method at the beginning of each billing period (monthly or annually) to ensure uninterrupted missed-call capture for your plumbing or home service business.
Cancellation Policy
We value your business and aim for transparency. Customers may cancel their subscription at any time according to the billing terms agreed upon during setup. Upon cancellation, access to the BlueTool AI receptionist system and SMS notification platform will continue until the end of the current paid billing cycle. No partial refunds are provided for utilized portions of a billing period.
Payment Obligations
All business users are responsible for maintaining valid payment information on file. Failure to process a recurring payment may result in a temporary suspension of call-handling services until the account is brought into good standing. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLUETOOL, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
LIABILITY CAP
UNDER NO CIRCUMSTANCES SHALL BLUETOOL BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO BLUETOOL HEREUNDER IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
BLUETOOL ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; AND (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.
GOVERNING LAW
THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF BLUETOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
